Type 1 — DALA
License Appeals
License suspended, revoked, denied, or not renewed. Also applies to licensees who receive a "not suitable" background check determination.
DALA — formal hearing, independent ALJ
21 days (5 business days for emergency suspensions)
Type 2 — EEC
Background Check Hearings
Assistants, candidates, employees, and caregivers who receive a "not suitable" determination after a background record check (BRC).
EEC — informal hearing, EEC hearing officer
21 days from "not suitable" determination
